TERMS AND CONDITIONS DISCLAIMER AND AGREEMENT

This Online Course Terms and Conditions Disclaimer and Agreement (“Agreement”) is made by and between Brodeur, LLC dba Aquarian Medicine, a business entity organized under the laws of the State of New York, (“Company”), and the undersigned purchaser (“Client”).

By registering for, purchasing, using, or continuing to use the Company’s services, participating in the Aquarian Medicine Vital Reset (“Program”), or accessing any part of the Company’s materials, Client agrees to be bound by the terms and conditions contained in this Agreement.
Selecting the “I agree to these terms and conditions” button during checkout constitutes an electronic signature and creates a legally binding agreement.

1. DEFINITIONS

1.1 “Program” means the Aquarian Medicine Vital Reset, a six-week immersive educational and transformational program designed to facilitate holistic self-awareness and energetic alignment through the integration of mind, body, spirit, soul, and space.

1.2 “Company’s Materials” include all written, digital, audio, and video materials, including but not limited to lessons, guides, workbooks, visual content, meditations, and resources provided to the Client as part of the Program.

1.3 “Intuitive Aquarian Medicine (IAM) Nutrition” refers to the proprietary educational system developed by Brodeur, LLC dba Aquarian Medicine, which teaches participants to cultivate intuitive awareness of their individual nutritional and energetic needs through self-observation, body intelligence, and alignment with the principles of holistic health.

1.4 “Client” means any individual, business, or entity who registers for, purchases, or participates in the Program and has paid all required fees.

1.5 “Commencement Date” means the date that payment is received in full and access to the Program is granted.

2. PROGRAM PURPOSE AND SCOPE

The Aquarian Medicine Vital Reset is an educational and experiential program intended to support participants in enhancing well-being, clarity, and alignment through energetic and holistic lifestyle education.

The Program integrates principles of Aquarian Medicine and the Intuitive Aquarian Medicine (IAM) Nutrition system, along with meditative, energetic, and self-reflective practices.

The Program’s purpose is informational and educational only. It is not a substitute for medical or psychological diagnosis, treatment, or individualized care. The Program does not provide medical nutrition therapy, psychotherapy, or healthcare services.

3. MEDICAL DISCLAIMER

The content contained in the Program—including IAM Nutrition teachings, nutritional guidance, energetic practices, and all educational materials—is for informational purposes only.

The Program is not intended as medical advice and should not be used to diagnose, treat, cure, or prevent any disease or condition.
Participants should consult their physician or qualified healthcare provider before beginning any new diet, fasting protocol, lifestyle change, or energetic practice.

If you are pregnant, nursing, taking prescription medication, or have any pre-existing medical conditions, you must obtain clearance from your healthcare provider before participating.

Brodeur, LLC dba Aquarian Medicine expressly disclaims any responsibility for adverse effects or consequences resulting from the use or application of any information provided in the Program. Participation is voluntary and undertaken at your own risk.

4. NO MEDICAL OR THERAPEUTIC RELATIONSHIP

Participation in the Program does not create a patient–provider, therapist–client, or any other medical or therapeutic relationship between the Client and the Company or its representatives.
All content and instruction—including IAM Nutrition—is intended for educational and self-development purposes only.
No diagnosis, treatment, or medical services are provided, implied, or promised through this Program.

5. LICENSE AND INTELLECTUAL PROPERTY

All Program content—including written, audio, video, digital, and proprietary materials under Aquarian Medicine and IAM Nutrition—are the intellectual property of Brodeur, LLC dba Aquarian Medicine and are protected by copyright and intellectual property laws.

The Client is granted a limited, personal, non-transferable, non-exclusive license to access and use the materials solely for individual learning.
Reproduction, distribution, recording, sharing, resale, or public display of any Program content without written authorization is strictly prohibited.
Any unauthorized use constitutes a material breach of this Agreement and may result in legal action.

6. PAYMENT TERMS AND REFUND POLICY

All Program fees must be paid in full (or according to an approved payment plan) before access is granted.

Because of the digital and immediately accessible nature of the Program materials, all sales are final, and no refunds, cancellations, or chargebacks will be accepted under any circumstances.

By completing the purchase, Client acknowledges full understanding of and agreement with this policy.

7. ACCESS AND PARTICIPATION

The Client is responsible for ensuring adequate technology and internet access to participate in the Program.
Company shall not be liable for any interruptions, inability to access, or delays caused by third-party platforms, maintenance, or other external circumstances.
Access to Program materials is for the sole use of the individual purchaser and may not be shared.

8. NO GUARANTEES OR WARRANTIES

The Company makes no express or implied guarantees of results or specific outcomes.
While many participants experience profound improvements in awareness, health, or alignment, individual results vary and depend on each participant’s unique circumstances, level of commitment, and readiness for change.

The Program and all related materials are provided “as is” and without warranties of any kind, either express or implied.

9. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Brodeur, LLC dba Aquarian Medicine, its affiliates, officers, employees, and representatives shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from participation in the Program or use of its materials.

This includes, but is not limited to, physical injury, illness, financial loss, emotional distress, or any adverse reaction arising from participation.
In no event shall the Company’s total liability exceed the total amount paid by the Client for the Program.

10. CONFIDENTIALITY

All Program materials, communications, and community interactions are considered confidential.
Client agrees not to share or disclose any proprietary content, discussions, or participant information to third parties.
Breach of confidentiality may result in termination of Program access without refund.

11. TESTIMONIALS AND MEDIA RELEASE

By submitting written, verbal, or video feedback, the Client grants the Company a perpetual, royalty-free license to use such testimonials (including name, likeness, and statements) for marketing, promotional, and educational purposes.
Client waives any right to compensation arising from such use.

12. NON-DISPARAGEMENT

Client agrees not to make public statements, written or oral, that could reasonably be construed to disparage, harm, or negatively impact the reputation of Brodeur, LLC dba Aquarian Medicine, its employees, or representatives.

13. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.
Any disputes shall be brought before the courts of Rockland County, New York and both parties consent to such jurisdiction.

14. ENTIRE AGREEMENT

This Agreement constitutes the entire understanding between the parties concerning the subject matter herein and supersedes all prior communications, whether oral or written.
Company reserves the right to amend or update this Agreement at any time. Continued participation constitutes acceptance of any updated terms.

15. ACKNOWLEDGMENT AND ACCEPTANCE

By registering for or purchasing the Aquarian Medicine Vital Reset, the Client acknowledges that they have read, understood, and agree to all the terms, conditions, and disclaimers contained in this Agreement.

Client understands that their participation in the Aquarian Medicine Vital Reset, including teachings under Intuitive Aquarian Medicine (IAM) Nutrition), is voluntary and at their own risk.
